IMMIGRATION, RIGHTS AND PANDEMIC.
PROPOSALS AGAINST DISCRIMINATION

 

The situation caused worldwide as a consequence of the COVID-19 pandemic has led to incidents of racism, xenophobia and intolerance directed at certain communities due to their nationality, racial or ethnic origin. These cases can be summarized in three areas: difficulty in accessing certain goods and services, concern regarding the statements of representatives of political parties and public figures, and the role of the media. These three areas of concern that have been appreciated at a European level and are also found in Spain.

Given this reality, it is necessary to pay special attention to the most vulnerable groups that have suffered from this discrimination, including immigrants. Indeed, foreigners, specifically those who are in an irregular administrative situation, have been the target of political speeches and the media in regard to the pandemic. This has made it difficult to guarantee and enjoy their rights.

This scenario requires, as will be analyzed in this presentation, to make proposals that ensure equality as a value, principle and norm. Two-way measures are urgent. On one hand, it is imperative to guarantee material equality by public administrations to all people, regardless of their racial or ethnic origin or their administrative situation. On the other hand, it is essential to promote the possibility of reporting any situation of discrimination, both your own and that of others, to prevent them from going unpunished. Only with firm public policies that act on both fronts, is it possible to strengthen the rule of law.

Ángeles Solanes Corella

Professor of Philosophy of Law and Political Philosophy at the Faculty of Law of the University of Valencia.

She has been president of the Council for the Elimination of Racial or Ethnic Discrimination (Secretary of State for Equality. Ministry of Equality) from 2018 to 2020.

Her research addresses issues related to human rights and legal-political philosophy from the perspective of Spanish and comparative law. Among these topics, she has studied multicultural societies, immigration policies, equality, the right to development, the SDGs and corporate social responsibility.

She is the author of several books and multiple articles in specialized scientific journals. Her most recent works include the book Derechos y Culturas. Los retos de la diversidad en el espacio público y privado (Tirant lo Blanch, Valencia, 2018).

She has participated in more than thirty international, European, national and regional research projects on these matters. She currently directs the R&D and Innovation Project PID2019-105018RB100 entitled “Racismo y Discriminación: los Derechos Humanos bajo amenaza” (Racism and Discrimination: Human Rights under threat), financed by the Ministry of Science and Innovation (Spain).

She has developed management and leadership activities at the University of Valencia, including her work as Vice Dean of International Relations at the Facultat de Dret (2010-2018).

She is a founding member of the University Institute of Human Rights of the University of Valencia, is part of the Aviseur National et International Committee of the Center d’Études Ethniques des Universités Montréalaises (Canada) and she was a member of the Technical Committee of the II National Human Rights Plan. In addition, she collaborates as an evaluator of different national agencies, among them, ANEP, AGAE, AGAUR and DEVA and of international programs such as InterTalentum MSCA-COFUND.

She is the director of the Anuario de Filosofía del Derecho and participates as an evaluator in different Spanish and foreign scientific journals.

She has carried out research stays at Universities and centers of recognized international prestige, among others, in Paris, Milan, Brussels, Geneva, London, San Diego, Bucharest, Toulouse, Moscow and Montréal.
